University Board of Appeals Procedures

Appeals to decisions by the Student Judicial Council, Student-Faculty Hearing Board, Interfraternity Council Judicial Board, or Panhellenic Council Judicial Board, may be made by the complainant, the accused, or a designated University Official to the University Board of Appeals (UBA); however, decisions of the Interfraternity Council Judicial Board or the Panhellenic Council Judicial Board that involve hazing or other serious violations of policies and might result in critical probation, suspension, or expulsion will be heard by the SAC Hearing Board and are not directly appealed to the UBA.

The UBA consists of: one administrator appointed by the Office of the Dean of Student Affairs (who in the case of a law student or an SFHB appeal will be an Administrator from the School of Law); a student appointed by the President of the Student Executive Committee; and, a faculty member appointed by faculty currently serving on the Student Affairs Committee. A notice of appeal must be delivered in writing to the Dean of Students, normally within 72 hours, of the decision of the judicial body. The appeal is scheduled within a reasonable time from receipt of the notice and is rescheduled only for exceptional circumstances as determined by the Dean of Students. An appeal does not constitute a rehearing of the case. Grounds for appeal are: penalty too harsh; penalty insufficient; new information; a lack of fair process; or extraordinary circumstances. Upon receipt of the written appeal, the University Board of Appeals shall review the appeal and the record of the judicial decision, and proceed in accordance with the rules of the appropriate judicial body.

Operational Procedures:

  • The Administrator appointed by the Dean of Students serves as the Chair of the UBA. 
  • The UBA hearing is confidential. 
  • The complainant/advocate, accused/advocate and the Chair of the judicial committee that reviewed the case will be invited to the UBA hearing. All have the right to speak at the hearing. 
  • The individual making the appeal will be asked to comment on the appeal. 
  • The chair of the judicial committee that reviewed the case will be asked to explain how/why the body reached its decision. 
  • Members of the UBA will ask questions concerning the appeal. 
  • Before closing the hearing, both the accused and the complainant can offer closing comments. 
  • Following the hearing, the UBA will meet in closed session to make the final decision.

The Chair of the UBA will communicate the decision of the UBA to the complainant and accused and the chair of the judicial committee.
